Farmer handed $1.3 million following false positive diagnosis for PD

Salmon farmer Måsøval has been awarded compensation from the Norwegian State following a legal battle over a misdiagnosis incident at one of its facilities.

The company had initially sought NOK 29.8 million ($2.9 million) for losses incurred after its Kattholmen facility was erroneously diagnosed with Pancreas Disease (PD) SAV3 in August 2019. This diagnosis had significant financial implications for the company.

The case, which was filed against the State by Måsøval, went to trial in November 2023. On 23 December 2023, a judgment was rendered, with the decision being communicated to the involved parties on 29 December 2023.

The court concluded that the Norwegian State, represented by the Ministry of Trade, Industry, and Fisheries, is liable for the damages caused to Måsøval due to the misdiagnosis.

As per the court’s ruling, the State is mandated to compensate Måsøval AS with NOK 12.8 million ($1.3 million). This amount covers the loss of earnings and expenses incurred by the company as a direct consequence of the misdiagnosis. Additionally, the compensation includes accrued interest and delay interest.

The judgment is still subject to appeal and therefore not yet legally binding.
