4. Legal Basis for Processing

We process your personal data based on the following legal grounds under Article 6(1) GDPR:

  • Consent (Art. 6(1)(a) GDPR): When you opt in to receive our newsletters or create an account, you provide your explicit consent. You may withdraw consent at any time by unsubscribing or contacting us.
  • Legitimate interest (Art. 6(1)(f) GDPR): We may process data for our legitimate interests, such as improving our Platform, ensuring security, and analyzing usage patterns, provided these interests are not overridden by your rights and freedoms.
  • Performance of a contract (Art. 6(1)(b) GDPR): Where processing is necessary to provide you with the services you have requested, such as maintaining your account.

5. Purposes of Processing

6. Data Sharing and Processors

We do not sell your personal data. We may share your data with the following categories of third-party processors who act on our behalf and under our instructions:

  • MailerLite: Our email marketing service provider, used to manage newsletter subscriptions and send newsletters. MailerLite processes your name, email address, and newsletter preferences. MailerLite’s own privacy policy is available at www.mailerlite.com/legal/privacy-policy.
  • Hosting and CDN providers: Our website is hosted on managed servers and uses Cloudflare as a content delivery network (CDN) for performance and security.
  • Analytics providers: We may use analytics tools to understand how visitors use our Platform.

All processors are bound by data processing agreements in accordance with Article 28 GDPR. We ensure that any third-party processor provides sufficient guarantees to implement appropriate technical and organizational measures.

7. International Data Transfers

Some of our processors may be located outside the European Economic Area (EEA). In such cases, we ensure that appropriate safeguards are in place, such as EU Standard Contractual Clauses (SCCs) or an adequacy decision by the European Commission, to ensure your data is protected to the same standard as within the EEA.

The initial transfer of subscriber data from the United Kingdom to the Netherlands was conducted under the UK–EU adequacy framework. The European Commission has recognized the UK as providing an adequate level of data protection, allowing for the free flow of personal data between the UK and the EU/EEA.

8. Cookies and Similar Technologies

Our Platform uses cookies and similar technologies to enhance your browsing experience, analyze site traffic, and understand where our visitors come from. You can manage your cookie preferences through your browser settings. For more detailed information, please refer to our Cookie Policy (available on our Platform).

9. Data Retention

We retain your personal data for as long as you maintain an active account or newsletter subscription with us, or as necessary to comply with our legal obligations. If you unsubscribe from all newsletters and delete your account, we will delete your personal data within 30 days, unless we are legally required to retain certain information for a longer period.

10. Your Rights Under the GDPR

Under the GDPR, you have the following rights with respect to your personal data:

  • Right to erasure: You may request deletion of your personal data, subject to legal retention requirements.
  • Right to restrict processing: You may request that we limit the processing of your data in certain circumstances.
  • Right to data portability: You may request to receive your data in a structured, machine-readable format.
  • Right to object: You may object to processing based on legitimate interest.

11. Sharing of Personal Data with Third Parties for Commercial Purposes

Salmon Business BV may share, license, or sell certain personal data to third parties for commercial purposes. This section explains in detail what data may be shared, with whom, for what purposes, and what your rights are in this regard.

11.1 What data may be shared?

The personal data that may be shared with third parties includes your name, email address, company name, job title (if provided), newsletter subscription preferences, and aggregated usage data (such as content engagement and interest categories). We will never share your password or account login credentials with third parties.

11.2 Who are these third parties?

Third parties may include companies operating in the salmon and seafood industry, trade organizations, market research firms, advertising and marketing companies, data brokers, and other commercial partners. These third parties may be located in the EEA, the United Kingdom, or other countries that provide an adequate level of data protection (or where appropriate safeguards such as Standard Contractual Clauses are in place).

11.3 For what purposes?

Third parties may use your data for their own commercial purposes, including but not limited to: direct marketing of their products or services, market research and analysis, targeted advertising, lead generation, and business development. Once your data has been shared with a third party, that third party becomes an independent data controller and their own privacy policy will apply to their use of your data.

11.4 Legal basis

The legal basis for sharing your personal data with third parties for commercial purposes is your explicit consent (Article 6(1)(a) GDPR). We will only share your data with third parties for commercial purposes if you have given us your prior, informed, and specific consent to do so. You will be presented with a clear opt-in mechanism (for example, a checkbox during account registration or in your account settings) before any such sharing takes place.

11.5 Your right to withdraw consent

You may withdraw your consent to the sharing of your data with third parties at any time, without affecting the lawfulness of processing prior to withdrawal. You can do so by updating your preferences in your account settings, or by contacting us at post@salmonbusiness.com. Please note that withdrawal of consent does not affect data that has already been shared with third parties prior to your withdrawal. To exercise your rights regarding data already held by a third party, you should contact that third party directly.

12. Data Security

We implement appropriate technical and organizational measures to protect your personal data against unauthorized access, alteration, disclosure, or destruction. These measures include encryption of data in transit (SSL/TLS), access controls, regular security assessments, and secure hosting infrastructure.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we make material changes, we will notify you by email (if we have your email address) and by posting the updated policy on our Platform with a revised “last updated” date. We encourage you to review this policy periodically.
